The short version

  • BizAppsMarket is a marketplace. Developers make and sell the apps. We test them, list the ones that pass, and, when checkout runs through us, take the payment.
  • An inspection score is our assessment on the date shown. It is not a warranty or a certification, and we do not certify legal or regulatory compliance.
  • If you buy through us, you can get a full refund within 14 days on your first purchase of an app or the first month of a subscription.
  • Ratings come only from businesses that paid through us and used the app for 30 days or more. Nobody can pay for them, and we do not hide bad ones.
  • Use the site lawfully and honestly. Our liability is limited, as section 12 explains.
  • These terms are governed by the laws of Florida.

This summary is here to help you read the full text below. The full text is what applies.

1. Who we are and what these terms cover

BizAppsMarket is operated by Blueridge Web Services LLC, doing business as BrainIT Consulting (“we”, “us”). These terms of service are an agreement between you and Blueridge Web Services LLC. They apply to everyone who uses BizAppsMarket: visitors, businesses that buy apps, and developers.

By using BizAppsMarket or creating an account, you agree to these terms and to our Privacy policy. If you use BizAppsMarket for a business, you agree for that business and confirm you are allowed to. “You” then means both you and the business.

Developers who join or send an app for review also agree to the Developer terms. Where the two differ on a developer matter, the Developer terms apply.

BizAppsMarket is for businesses in the United States. You must be 18 or older and able to enter a binding contract to use it.

2. Accounts

  • Give us accurate details and keep them up to date.
  • Keep your sign-in methods safe. You are responsible for what happens under your account. Tell us straight away if you think someone else has used it.
  • One person per account. Do not share your sign-in with anyone.
  • We may refuse an account, or suspend or close one, as section 14 explains.

3. Acceptable use

When you use BizAppsMarket, do not:

  • break the law or anyone else’s rights;
  • give false information, pretend to be someone else, or misrepresent a business;
  • try to get into accounts, systems or data you are not allowed to reach, or test our security without our written permission (please report security problems to support@dreamforgeworld.com);
  • interfere with the site, overload it, or get round its limits;
  • copy listings or reports in bulk, or scrape the site;
  • upload malware or anything else meant to cause harm;
  • post anything unlawful, defamatory, harassing, hateful, or that infringes someone else’s rights;
  • manipulate ratings, rankings or our records of introductions;
  • use BizAppsMarket to find a buyer or a seller and then get round our commission.

4. What we do, and what developers do

Developers make and sell the apps. Each developer is responsible for their app: how it works, its support, the data it holds, and its own terms and privacy policy. Your agreement to use an app is with its developer, under the developer’s terms, which the listing links to.

We review apps and list the ones that pass. Every app is tested before it is listed, and a person approves every listing. We decide what to list, and we can decline or remove a listing under the Developer terms.

Apps made by us. Some apps are made by BrainIT Consulting or our staff. Their listings and catalogue cards say “Made by BrainIT Consulting, the company that runs BizAppsMarket” or “Made by BizAppsMarket staff”. They take the same review as every other app, are never approved by the person who made them, and get no better place in the catalogue: it lists apps newest first, whoever made them.

Our independence. BrainIT Consulting, the business that runs BizAppsMarket, also offers consulting and development work. It does no paid work on an app while that app is under review or listed here. No payment to us changes a score or an approval.

5. Buying through BizAppsMarket

Checkout through BizAppsMarket is not open yet. When it opens, these rules apply to every purchase made through it.

  • Price. You see the price, what it includes and how often you are billed before you pay. Prices are in US dollars. We add sales tax where we must collect it.
  • Payment. You pay us, through Stripe. We are the merchant of record for the payment, so our name appears on your receipt and card statement. We pass the developer’s share to the developer. The developer still provides the app and is responsible for it.
  • Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from your account, and you keep access until the end of the period you paid for.
  • Refunds: at least 14 days. If you ask within 14 days of paying for your first purchase of an app, or the first month of a subscription, we refund that payment in full. You do not need to give a reason. Some developers offer longer; the listing says so, and we hold them to it. After that, the developer’s own refund policy applies.
  • Our help. If a developer stops answering within the reply time on their listing, tell us. We will chase them, and where it is fair we will refund you.
  • Disputes about a charge. Please contact us before you dispute a charge with your bank. Most problems are faster to fix directly.

Free apps have no payment and so no refund, but every other part of these terms applies.

6. What an inspection score means

An inspection score is our assessment of an app as we found it on the date shown, using the checks and scoring rules we publish. Automated tools and AI do much of the testing, and a person approves each listing.

It is not a warranty, a guarantee, a certification or an endorsement. Apps change after we review them. A good score does not mean an app is free of bugs or security problems, or that it suits your business. Our accessibility result is an automated check, not a full audit.

  • Code-reviewed means we tested the demo and reviewed the code. Demo-tested means we tested the demo only.
  • “Developer states…” items are the developer’s own statements, for example about HIPAA or card data. We do not check them. BizAppsMarket does not certify legal or regulatory compliance. If your business is regulated, check with the developer and your own advisers before you put regulated data into any app.
  • “Not tested by BizAppsMarket: needs paid usage” marks a feature we did not test because it costs money each time it runs.
  • We re-test listed apps. If a re-test passes, the listing shows the new score and its date, which can be higher or lower than before. If a re-test fails, the listing keeps the score from the last review the app passed and says that a re-test found problems and the date the developer must fix them by. If they are not fixed by then, the listing comes down.

You decide whether an app is right for your business.

7. Ratings and reviews

Ratings open with checkout. These rules apply to every rating and written review.

  • Only real customers. A business can rate an app only if it paid for the app through BizAppsMarket and has used it for at least 30 days. One rating per business per app; you can update it.
  • No paid or rewarded reviews. Nobody may offer or accept money, discounts, free service or anything else of value for a rating, or for changing or removing one. Nobody may review their own app, a competitor’s app, or an app they have a business or family connection with.
  • We do not hide negative reviews. We remove a review only if it breaks these rules: it is fake or misleading, contains someone’s personal information, is abusive, hateful or sexual, is unlawful, or is not about the app. The same rules apply to good and bad reviews.
  • Developers may reply once, publicly, to each review. Replies must be civil and must not include the reviewer’s personal information.
  • If you think a review breaks these rules, tell us through our contact form.

8. Content you give us

You keep ownership of what you post or send us, such as listing text, screenshots, reviews and replies. You give us a non-exclusive, worldwide, royalty-free licence to host, copy, display, format and share it to run and promote BizAppsMarket, for as long as it is on the site and for a reasonable time after, for copies already made.

You confirm you have the right to give us this licence, and that your content does not break the law or anyone’s rights. If you send us ideas or feedback, we may use them without paying you.

9. Our intellectual property

BizAppsMarket, its name, logo and hallmark, its design and its inspection reports belong to us or the people who license them to us. You may use the site for its intended purpose. Do not copy it, or use our name or logo in a way that suggests we endorse you, except as the Developer terms allow.

Copyright complaints. If you believe something on BizAppsMarket infringes your copyright, email support@dreamforgeworld.com with: your contact details; the work you say is infringed; where it appears on BizAppsMarket; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you own or act for the owner of the copyright; and your signature. We remove material that infringes and close the accounts of repeat infringers.

10. Other websites and apps

BizAppsMarket links to developers’ websites and apps, and to services such as Stripe and Google. We do not run them and are not responsible for them. Their own terms and privacy policies apply.

Back to contents

11. Disclaimers

BizAppsMarket and everything on it are provided “as is” and “as available”. As far as the law allows, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not promise that the site will always be available or free of errors, or that any listed app will meet your needs, work as described, be secure, or comply with the laws that apply to your business. Apps are provided by their developers, and any warranty for an app comes from its developer.

Some states do not allow some of these exclusions. Where that is so, they apply only as far as the law allows.

12. Limits on our liability

As far as the law allows:

  • We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if we were told they were possible.
  • We are not liable for apps made by other developers, or for what those developers do or fail to do.
  • Our total liability for all claims about BizAppsMarket or these terms is limited to the greater of $100 and the fees you paid us in the 12 months before the event that led to the claim. For a buyer, “fees” means our commission on your purchases, not the part of the price paid to the developer.

Nothing in these terms limits liability that the law does not allow us to limit, such as for fraud or for harm we cause on purpose.

Back to contents

13. Your responsibility for claims

If someone makes a claim against us because of your content, your app, your breach of these terms, or your breaking the law or someone’s rights, you will defend us and cover our resulting losses and reasonable legal costs. This covers BrainIT Consulting, its owners, staff and contractors. We will tell you about the claim promptly and let you run the defence. You may not settle a claim in a way that admits fault for us without our written agreement.

Back to contents

14. Suspending or closing accounts

You can stop using BizAppsMarket at any time. To close your account, email support@dreamforgeworld.com or use our contact form. Developers cancel memberships under Manage membership.

We can suspend or close an account, or remove content, if you break these terms, if we must do so by law, to prevent fraud or harm, or if we stop running BizAppsMarket. We tell you why unless the law or security stops us. Apps you bought before then stay covered by the developer’s terms and by section 5.

Sections that by their nature should last after your account ends do so, including sections 8, 9 and 11 to 17.

Back to contents

15. Governing law and disputes

Talk to us first. If you have a dispute with us, contact us and describe it. We will try to settle it with you within 30 days before either of us goes to court.

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any court case about BizAppsMarket or these terms must be brought in the state or federal courts of Florida, and both of us agree to those courts’ jurisdiction. Either of us may instead bring a claim in small claims court if it qualifies.

Back to contents

16. Changes to these terms

We may update these terms. We post the new version here with a new effective date. If a change affects fees, how we use your information, or how disputes are handled, we email account holders at least 14 days before it takes effect. Other changes, such as clearer wording, take effect when posted. If you keep using BizAppsMarket after a change takes effect, the new terms apply. Changes do not apply to a dispute that started before them.

17. General

  • These terms, the Privacy policy and (for developers) the Developer terms are the whole agreement between you and us about BizAppsMarket.
  • If a court finds part of these terms unenforceable, the rest still applies.
  • If we do not enforce a term straight away, we can still enforce it later.
  • You may not transfer your rights under these terms without our agreement. We may transfer ours if our business or BizAppsMarket is sold or merged.
  • We are not responsible for delays caused by events outside our reasonable control.
  • We send notices to the email address on your account. Send notices to us at support@dreamforgeworld.com.
  • These terms do not make us partners, employer and employee, or agents of each other.
